This petition has been filed seeking directions to Motor Accidents Claims Tribunal ['MACT'], East, Karkardooma Courts, to expeditiously dispose of the matter which has been pending before it, being, MACT No. 404/2021 tiled as, "Manorama Dash v. Dinesh Kumar & Ors." 2.

Mr. Pratap Ranjan Sahani, counsel for petitioner, states that the matter was put up for orders on 31st May 2024, after directing for submissions to be filed on 29th May 2024. IO was present in person on 26th November 2025. On 6th August 2025, since the IO was on leave, fresh summons were issued for 16th September 2025. It seems that the IO has not appeared since, as stated by counsel for petitioner.

In order dated 25th March 2026, MACT noted that the IO was bound down to appear, however, the IO was still absent and bailable warrants were issued for a sum of Rs. 10,000/- to be executed through the concerned SHO and the matter has now been put up for appearance of IO on 08th July 2026. 5.

Despite repeated attempts and directions passed by the MACT, the IO has chosen not to appear, therefore, stalling the proceedings in the claim petition.

Considering the conduct of IO and repeated absence, as noted, in response to the summons issued by MACT, it is thereby, directed that the IO shall be present on the next date of hearing before the MACT i.e. 08th July 2026, otherwise, his absence will be treated as contempt of Court. 7.

Copy of this order be sent to SHO, Pandav Nagar to ensure compliance.

Report which has to be filed by the IO, will be made available by the IO on 08th July 2026, positively, and queries will be duly addressed. 9.

The accident in question had taken place on 24th October 2021, when the petitioner lost her son, who was a driver working at OLA/Rapido, but was driving his own vehicle at the time of the accident. It has been stated that she has been facing financial crisis, therefore, it is expected that the MACT shall dispose of the matter expeditiously on or before 15th September 2026.
