Vide order dated 16.05.2023, this Court had noted the submission of the learned counsel for the petitioner that an FIR was also registered at the instance of one of the petitioners, namely, Amit (petitioner in BAIL APPLN. 1609/2023) which contains all bailable offences despite Manoj (brother of Amit) having suffered a fracture, which creates a serious doubt about the genesis of the incident dated 10.04.2023 as projected by the prosecution in present FIR No. 251/2023 as well as with regard to the overt acts committed by the complainant and her husband.

Considering the submission of the learned counsel for the petitioner, interim protection was granted to the petitioners subject to their joining investigation.

The learned counsel for the petitioner submits that petitioners have joined the investigation as and when required by the Investigating Officer, which position is not disputed by the learned APP, on the instructions from the Investigating Officer, who is present in Court. The learned APP further apprises the Court that the petitioners are no more required for any further investigation.

In view of the above, it is directed that in the event of petitioners being arrested, they be released on bail subject to their furnishing personal bond in the sum of Rs. 25,000/- each and a surety bond of the like amount to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
the satisfaction of the Investigating Officer / Arresting Officer subject to further condition that they will join investigation as and when directed by the IO concerned.
