O R D E R

% 06.10.2025 Learned counsel appearing for the parties inform the court that parties have settled the matter through mediation. A copy of Settlement Agreement dated 21.08.2025 has been placed on record. 2.

Counsel submit, that in view of clauses 2 and 3 of the settlement agreement, the amount deposited by the appellants in compliance of order dated 24.03.2021, comprising 75% of the decretal amount and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the per month mesne profits as directed by that order, are to be divided equally between the appellants and the legal representatives of the respondent.

Learned counsel for the parties accordingly pray, that the appeal be disposed-of in terms of the settlement agreement; and the Registry be directed to release the aforesaid amount equally between the two sides.

In view of the above, the appeal is disposed-of in terms of the settlement contained in Settlement Agreement dated 21.08.2025, holding the parties bound by the said terms, and in particular clause 1 thereof, which requires the appellants to surrender vacant possession of the suit property to the legal representatives of the respondent on or before 31.03.2026.

Furthermore, the Registry is directed to release the amount lying deposited in this matter, alongwith interest upto-date, equally to Mr.Vijay Kumar/appellant No.1 and to Mr. Vivek Kumar, one of the legal representatives of the respondent, who will receive it for themselves and on or behalf of the other appellant and other legal representatives of respondent respectively. Let the needful be done within 02 weeks of the parties approaching the Registry for the purpose.

The appeal is disposed-of in the above terms. 7.

Pending applications, if any, stand disposed-of. 8.

Furthermore, learned counsel appearing for the appellants submits that the court fee affixed on the appeal be refunded to them. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In view of section 16A of the Court Fees Act 1870, as applicable to Delhi, the Registry is directed to refund to the appellants half of the court fee affixed on the memo of appeal.
