The present petition has been filed for directions to the respondent nos. 1 to 3 and 9 to take appropriate action against respondent nos. 4 to 8, thereby stopping the illegal and unauthorised construction being carried out in property no. KD-76C, Ashok Vihar, Phase-1, Delhi-110052. 2.

("MCD"), on advance notice, submits that he has instructions to submit that, no construction is being carried out in the property in question. He further submits that no building material was found in the property in question. 3.

Learned counsel appearing on behalf of respondent nos. 4 to 7 on advance notice also submits that no construction is being carried out on their behalf in the property in question.

This Court notes that in Para 5 of the present petition, it has been stated that unauthorised construction is being carried out, on the fourth and fifth floor of the property in question.

However, attention of this Court has been drawn to the various photographs filed along with present writ petition, by the parties appearing before this Court, to submit that the property in question consists of only ground floor, first floor, second floor and third floor. It is categorically submitted that no fourth or fifth floor exists in the property in question. 6.

Considering the submissions made before this Court, no merit is found in the present petition.

The present petition, along with the pending application, is accordingly, dismissed.
