The hearing was conducted through video conferencing. 2.

The learned counsel for the petitioner states that as of last evening, he has been informed by ICICI Bank that they have referred petitioner's dispute to Visa - the credit card facilitator for refund of petitioner's monies from the Airlines concerned. In effect, the primary issue apropos the lis as raised by the petitioner stands attended to and the above, the petition has become infructuous.

In the circumstance, the learned counsel for the petitioner does not wish to press the petition at this stage and seeks to withdraw it with liberty to approach the Court in altered circumstances. 4.

The petition, alongwith pending application, is dismissed as withdrawn. Liberty granted.
