Petitioner herein is landlord who has filed eviction petition under Sections 14(1)(b), 14(1)(d), 14(1)(hh) & 14(1)(k) of the Delhi Rent Control Act, 1958 (in short 'DRC Act') .

However, in context of ground of sub-letting under Section 14(1)(b) of DRC Act, based on the averments made in the written statement by the tenant, the landlord moved an application seeking decree on admission under Order XII Rule 6 CPC.

Such application has been dismissed by the learned Controller vide order dated 10.02.2023, which order is under challenge. 4.
When asked as to what is the present stage of aforesaid eviction petition, learned counsel for the petitioner submitted that it is already at the stage of petitioner's evidence.

After hearing arguments for some time, learned counsel for petitioner states that, without prejudice to his rights and contentions, he would not press the present petition if a request is made to the learned Controller to expedite the disposal of the aforesaid eviction petition in a time-bound manner. 6.
Learned counsel for the respondent/tenant is also present in the Court and, on instructions, states that requisite co-operation and assistance in this regard shall be given to the learned Controller so that learned Controller is in a position to dispose of the aforesaid case as quickly as possible. 7.
In view of above statement, the present petition is disposed of as not pressed. Simultaneously, learned Controller is requested to decide the aforesaid eviction petition as expeditiously as possible, preferably, within eight months from today. Needless to say, both the sides would render due assistance to the learned Controller.
