BAIL APPLN. 1406/2020 1.

By this petition, the petitioner seeks extension of interim bail granted to the petitioner by this Court vide order dated 18th May, 2020 for the surgery of his wife in case FIR No. 93/2019 under Sections 20 NDPS Act registered at P.S. Mahendra Park.

As per the medical records filed, it is evident that the petitioner could not get the surgery of his wife performed during this period of 45 days as her liver condition was not good and the Doctor opined that she needs to BAIL APPLN. 1406/2020

stabilize due to the poor liver condition. Since as late as 10 days ago, the condition of the petitioner's wife was poor and surgery of the gall stone is not an emergent surgery, it is evident that the petitioner's wife needs some more time to recover, whereafter only the surgery can be performed. Consequently, this Court finds no ground to grant extension of interim bail to the petitioner.

Petition is dismissed.
