The present petition under Article 226 of the Constitution of India read with Section 528 of the BNSS seeks following prayers:- "a) pass a writ of mandamus or any other writ, order or direction thereby quashing/setting-aside the Order of Conviction as well as Sentence Order both dated 12.02.2025 passed by the Hon'ble Court of Sh. Vaibhav Chaurasia, Plea Bargaining Judge, ACJM- 04, Rouse Avenue District Court, New Delhi in C.C. No.CBI/01/ 2024, R.C. No. 7(S)/2023/CBI/SCI/New Delhi titled as CBI Vs. Pumendu Kumar @Kundan Singh; (b) acquit the petitioner/convict in the present case; (c) pass any other order(s) or relief(s), which this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the case may kindly be passed in favour of the petitioner. It is prayed accordingly," 3.
Learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law challenging the impugned order.
