The present petition under Articles 226/227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks quashing of FIR No. 213/2016, under Sections 354A/341/323/506/34 of the IPC, registered at P.S. Sonia Vihar and all other consequential proceedings emanating therefrom, including the chargesheet pending before the court of Ms. Dhanashree Deka Ld. Additional Chief Judicial Magistrate, North East District, Karkardooma Courts, Delhi.

minor dispute between the parties. It is submitted that as a result of the said dispute, a cross-FIR, i.e., FIR No. 212/2016, under Sections 323/341/506/34 of the IPC was registered at P.S. Sonia Vihar, at the instance of the petitioner no. 1 herein.

It is further submitted that during the pendency of the aforesaid proceedings, the parties have entered into a Settlement deed dated 24.08.2024, pursuant to which parties have no objection to quashing of the cross FIRs. The cross FIR, i.e, FIR No. 212/2026, under Sections 323/341/506/34 of the IPC, was registered at P.S. Sonia Vihar, which has been compounded by the learned Trial Court vide order dated 05.12.2024. 6.

Petitioners and the complainant/respondent no. 2 are present before the Court today and have been duly identified by their respective counsel, as well as the Investigating Officer, SI Deependra, PS Sonia Vihar. 7.

The complainant/respondent No.2 states that the matter has been settled with the petitioners and he has no objection if the FIR is quashed. 8.

In Gian Singh v. State of Punjab, (2012) 10 SCC 303, the Hon'ble Supreme Court has recognized the need of amicable resolution of disputes by observing as under:- "61. ... In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceeding." 9.

Sonia Vihar and all other consequential proceedings emanating therefrom, including the chargesheet pending before the court of Ms. Dhanashree Deka Ld. Additional Chief Judicial Magistrate, North East District, Karkardooma Courts, Delhi, is hereby quashed.
