The petitioners have filed the present petition, inter alia, praying that the petition filed under Section 34 of the Arbitration and Conciliation Act, 1996 (Surjeet Singh & Anr. v. True Zone Buildwell Pvt. Ltd.: OMP (Comm.) 28/2018), be transferred from the court of the learned Additional District Judge, South-East District, Saket, to this Court. The petitioner states that the said petition was filed for setting aside of an arbitral award dated 05.02.2018 passed by the Sole Arbitrator, Shri Arun Francis. The petitioner states that the sole arbitrator has also rendered other awards in similar terms which have been assailed by the concerned parties under Section 34 of the Arbitration and Conciliation Act, 1996.

It is stated that eleven other such matters are listed for hearing before this Court on 05.08.2019. The learned counsel appearing for the petitioners submits that the issues involved in the said petitions are identical to the

issues involved in the present petition filed by the petitioner. Further, the award, in favour of the respondent, has been rendered by the same Sole Arbitrator and in identical terms.

The said facts are not disputed by the learned counsel appearing for the respondent. Further, the learned counsel for the respondent also has no objection if the present petition is transferred. 3.

Accordingly, the petition captioned 'Surjeet Singh & Anr. v. True Zone Buildwell Pvt. Ltd.: OMP (Comm.) 28/2018' is withdrawn from the court of Additional District Judge, South-East District, Saket, to this Court. 4.

The parties are directed to appear before the concerned Court on 05.08.2019.

The pending application stands disposed of.
