By way of the present petition, the petitioner seeks expeditious disposal of an application filed by him under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, pending before the Court of the learned Additional Chief Judicial Magistrate-02 (Central), Tis Hazari Courts ["ACJM"].

Mr. A.K. Suri, learned counsel for the petitioner, draws my attention to an order dated 17.03.2026 passed by the learned ACJM, whereby a prima facie observation has been recorded that only the offence of criminal breach of trust appears to be made out in the matter, and an Action Taken Report has further been called for from the concerned police station. It is further pointed out that the application has been adjourned to 10.07.2026.

Mr. Suri submits that the petitioner may be permitted to move an appropriate application before the learned ACJM seeking advancement of the date of hearing. The learned ACJM is requested to consider such request in accordance with its own Board and the age of the matters pending before it, and to dispose of the application as expeditiously as possible.

Mr. Suri also seeks to reserve the rights and contentions of the petitioner to be urged before the learned ACJM, in respect of the offences in relation to which registration of the FIR may ultimately be directed. 5.

As the observations of the learned ACJM in the order dated 17.03.2026 are expressly of a prima facie nature, the intervention of this Court is not warranted at this stage. It is, however, open to the petitioner to advance his submissions before the learned ACJM, in accordance with law.

The petition is, accordingly, disposed of with these directions.
