The present petition under Section 482 of the Cr.P.C. has been filed seeking the following prayers:- "A - To quash the proceedings ofMt. Case No. 87 of 2022 , ;' Smt. Pooja Versus Naresh Kumar' , under section 125 , Cr.P.C. , pending before the Ld. Judge, Family Court (North - East) , K.K.D. , Delhi, since the Respondent ( wife) on the very first date of hearing has turned down the offer to live with the Respondent ( Husband) and is not willing to live with the Petitioner. B - To quash the interim Maintenance Order dated 31 - 01 - 2023 , awarded @ Rs. 5300/- only p.m. in favour of the Respondent (wife) as against the Petitioner (Husband) in Mt. Case No. 87 of 2022 , ' Smt. Pooja Versus Naresh Kumar, under section - 125 Cr.P.C. before the Ld. Judge, Family Court ( North - East) , K.K.D., Delhi.

C - To award cost in favour of the petitioner as against the Respondent.

D - To pass any other or further orders which in the circumstances of the case the Hon'ble.Court may deem just and proper in favour of the Petitioner as against the Respondent." Learned counsel appearing on behalf of the respondent submitted that present petition had been filed challenging the interim order of maintenance in MT No. 87/2020, however, the final judgment/order in the said proceedings has since been passed on 07.05.2024.

None appears on behalf of the petitioner today. There was no appearance on behalf of the petitioner on the last two dates of hearing as well, i.e., 01.10.2024 and 28.11.2024.

In view of the above, the present petition is dismissed in default for non-prosecution and disposed of accordingly.

Pending application, if any, also stands disposed of accordingly.
