This hearing has been held through video conferencing. 2.
The Applicant seeks interim bail for 45 days in terms of the minutes of the High Powered Committee dated 18th May, 2020. He has been accused of offences under Sections 302/34 IPC and has been in custody since 22nd September, 2017. A perusal of the order of the ld. Sessions Judge dated 1st June, 2020 shows that the reason why bail was rejected was due to some other FIR No. 151/2013, which was allegedly pending against the Applicant. However, a perusal of the nominal roll received from the Jail Superintendent, Central Jail No.4, Tihar Jail, New Delhi reveals that there is no such FIR.

Insofar as the unsatisfactory conduct is concerned, there was an incident which took place on 20th May, 2018 for which the Applicant was adequately punished by stopping of mulakaat and phone call facility. 4.
Considering the above facts and the fact that the Applicant's case is covered by the minutes of the High Powered Committee dated 18th May, 2020 and the fact that the Applicant has been in custody for more than two By:PRATHIBA M SINGH
years and is not involved in any other case and his conduct is satisfactory for the last one year as per the nominal roll, the Applicant is granted interim bail for a period of 45 days from the date of his release, subject to the following conditions:
i) That a personal bond to the tune of Rs.10,000/- shall be furnished by the Petitioner along with a surety of the like amount to the satisfaction of the Jail Superintendent, Central Jail No.4, Tihar Jail, New Delhi;
ii) The Applicant shall not contact any witnesses directly or indirectly or indulge in any act that may impede the trial; iii) The Applicant shall provide his active mobile number to the I.O. and the I.O. shall keep in touch with the Applicant on a regular basis. The Applicant shall also provide his residential address to the IO. iv) The Applicant shall not travel outside Delhi 5.
The Applicant shall surrender immediately upon the expiry of the bail period. Copy of this order be communicated to the Jail Superintendent, Central Jail No.4, Tihar Jail, New Delhi.

The bail application is disposed of in the above terms. All pending applications are also disposed of.
