1. The present application has been filed under Section 439 Cr.P.C for grant of regular bail to the applicant, Abuzar, in FIR No. 346/2023 under Sections 394/411 IPC, registered at PS New Friends Colony. The FIR is based on the complaint of Rahul Pal, who reported that on 11/10/2023, while returning from Khizrabad Chowk, Abuzar attempted to snatch his phone by biting his lips, pressing his neck, and restraining him. The public intervened, beat the accused, and recovered the phone. After medical examination and investigation, Abuzar was arrested, and it was revealed that he was involved in previous criminal cases. 2. Learned APP for the State has informed that the case is at the stage of 313 Cr. PC. the petitioner is in custody since 11.10.2023.

3. In respect of the previous involvement, the accused has been acquitted in the case FIR No.263/2013.

4. Learned APP for the State submits that besides this, the accused is also involved in case FIR No.120/2013 under Section 320 Cr. PC.

5. The petitioner is in custody since 11.10.2023 and is 32 years of age. The prosecution testimony has already been recorded. Taking into account the facts and circumstances, the petitioner is admitted to bail upon furnishing a personal bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the concerned learned trial court, subject to the verification of address and provide his mobile number(s) and subject to the following further conditions: a) the petitioner shall regularly appear before the IO/trial court as and when directed;

b) the petitioner shall not directly or indirectly make any inducement, threat, intimidate or tamper with any person acquainted with the facts of the case;

c) the petitioner shall remain available on the address, to be given to the IO and shall not leave the country without the permission of the learned Trial Court;

d) In case of change of residential address and/or mobile number, the petitioner shall intimate the same to the Investigating Officer/ Court concerned by way of an affidavit.

7. A copy of this order be sent to concerned Jail Superintendent for information and necessary compliance.
