A Petition under Section 482 Cr.P.C read with Article 226 of Constitution of India has been filed on behalf of the Petitioner for quashing of FIR No.43/2019 under Section 420 IPC registered at Police Station Sarai Rohilla, now transferred to EOW (Mandir Marg). 2.

It is submitted that the Chargesheet has already been filed on 03.06.2023 and the matter is now pending for arguments on Charge. 3.

The grounds essentially taken for quashing of the FIR is that the allegations made therein are absurd and highly improbable. Such allegations in fact are border to the merits of the case. Since, the Chargesheet has been filed, the Petitioner is at liberty to take the contentions raised herein before the learned Trial Court.

Learned counsel for the Petitioner seeks permission to withdraw the present Petition to raise these contentions before the learned Trial Court or to avail the appropriate remedy in accordance with law.
