The present writ petition has been filed by the Petitioner praying for quashing of FIR No.228/2015, under Section 363 IPC, registered at P.S. Sonia Vihar and consequential proceedings arising therefrom. 2.

On behalf of the State, Mr.Avininder Singh, A.S.C. has submitted that statement of the Prosecutrix under Section 164 Cr.P.C. has been recorded. It is further submitted by learned A.S.C. for the State that in view of the nature of the statement made by the Prosecutrix being 19 years of age as stated by her, a cancellation report may be filed in the matter shortly. 3.

In view of the submissions made by learned A.S.C. for the State, learned counsel for the petitioner on instructions submits that petitioner may be permitted to withdraw this writ petition with liberty to approach the Court if necessity arises.
