CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 30.07.2020 [Hearing held through video conferencing] 1.

The petitioner has filed the present petition, inter alia, praying as under:- "a. direct the Respondent to consider the Appeal No. 11/2020 title as Gayatri Srivastava Vs. Sparsh Special School and Ors as urgent and conduct the proceedings/hearings in the said Appeal through Video Conferencing for the time being until physical appearance starts; and b. direct the respondent to provide proper infrastructure to the Delhi School Tribunal/respondent no.2 in order to enable it to conduct the proceedings in the fresh and pending urgent cases through Video Conferencing and also to prepare and launch the official Web site of the respondent no.2 on the lines of the websites of other

Courts and Tribunals giving all necessary information for the benefits of all stakeholders. "

2.

The learned counsel appearing for the respondents states that a hearing through video conferencing is not possible because the equipment for conducting such conference is not available with respondent no.2 and respondnet no.1 is not in a position to immediately provide the same. However, he also states that the respondent no.2 (Delhi School Tribunal) is hearing urgent matters if counsel for both the parties are ready and willing for a physical hearing.

3.

In view of the above, the prayers as sought for by the petitioner cannot be granted. However, since it is stated that the respondent no.2 is taking up urgent hearing matters, this Court considers it apposite to direct respondent no.2 to consider the petitioner's email dated 25.06.2020 requesting that her application be taken up on an urgent basis. If the petitioner's application for an early hearing is meritted, the Tribunal shall take up the matter at a physical hearing.

4.

The petition is disposed of with the aforesaid directions. VIBHU BAKHRU, J JULY 30, 2020 pkv
