The learned counsel for the petitioner submits that the learned Trial Court had erroneously recorded that the documents were not seized by the Central Bureau of Investigation ('CBI'). 2.

He, at the outset, seeks to withdraw the present petition with liberty to take recourse to his remedies during the crossexamination of the witnesses, at an appropriate stage. 3.

He, however, requests that the cost imposed on the petitioner by the learned Trial Court by order dated 06.11.2023, be waived since the petitioner is a senior citizen who retired long back, and imposition of cost would be onerous. 4.

The learned Standing Counsel for Central Bureau of investigation (CBI) very fairly submits that he has no objection if the cost imposed by the learned Trial Court is waived. Even though this Court finds no infirmity with the order dated 06.11.2023 passed by the learned Trial Court imposing the cost of ₹10,000/- on the petitioner, however, considering the facts as noted above and there being no objection by the learned counsel for CBI, the cost imposed by order dated 06.11.2023 is set aside.
