ARB.P. 82/2018 The present petition is filed under Section 11(5) and (6) of the Arbitration and Conciliation Act, 1996 seeking appointment of a sole arbitrator to adjudicate the disputes between the parties. Some of the relevant facts are that the parties entered into an agreement on 09.05.2015 regarding construction of a residential building at Plot B-1, Section 36, Noida, U.P. Disputes having arisen between the parties, the petitioner has invoked the arbitration clause on 09.12.2017. It is also pointed out that a petition under Section 9 of the Act is also pending adjudication before another court.
Learned counsel for the respondent on receipt of an advance notice has entered appearance. He very fairly states that he has no objection to the appointment of the Arbitrator by this court.
Accordingly, Mr.Shashank Garg, Advocate (Mobile No.9811526671) is appointed as the Sole Arbitrator to adjudicate the disputes between the parties. The learned Arbitrator will charge his fees as per the Fourth Schedule of the Arbitration Act.
The petition stands disposed of.
