Mr. Rajeev Gakhar, learned counsel for the appellant No.5 submits that settlement took place between the appellants No. 1 to 4 and no settlement has taken place with the appellant No.5. However, the appellant No.5 has no objection to withdrawal of the appeal with the permission to file a fresh case before the learned Trial Court. 4.

No one is present for the respondent.

Accordingly, the present appeal is disposed of as compromised. The pending application is also disposed of.
