The present Letters Patent Appeal ('LPA') impugns the judgment dated 14th February, 2024 ('Impugned Judgment') passed by the learned Single Judge in Writ Petition (Civil) No. 147/2024, whereby the learned Single Judge restored the result of the Respondent No.1 herein for DNB Final Examination, April, 2023 which was cancelled by the Appellant vide communication dated 30th November, 2023. By the Impugned Judgment, the learned Single Judge also directed that the Respondent No.1 herein would also be entitled for the award of DNB qualification in accordance with law. Challenging the Impugned Judgment on various grounds, the Appellant herein has raised various questions of law in the present LPA. However, since the Respondent No. 1 herein has already cleared the theory as well as the practical examinations conducted for DNB Final Examination, April, 2023, this Court is not inclined to interfere with the relief granted by the learned Single Judge to the Respondent No.1. 3.

Needless to mention that this order is being passed in the peculiar facts and circumstances of the present case and the judgment of the learned Single Judge shall not be cited as a precedent. The questions of law raised in the present LPA are also kept open.
