The hearing was conducted through video conferencing. 2.

Petitioner impugns order dated 05.03.2020 whereby the Financial Commissioner has remitted the matter to the Excise Commissioner with the direction to re-examine the matter in the light of the existing laws, rules and regulations regarding the requirement of legal possession of premises as a mandatory requirement at the time of applying for a licence from the Excise Department.

Learned counsel for the petitioner submits that in case directions are issued to the Excise Commissioner to expedite the hearing of the case and dispose of the same, petitioner shall not press his petition. W.P. (C) 3827/2020

Without commenting on the merits of the case and keeping in view of the facts and circumstances, the Excise Commissioner is directed to dispose of the matter expeditiously.

In view of the above directions, learned counsel for the petitioner seeks leave to withdraw the Petition.

The petition is dismissed as withdrawn with the aforesaid directions. 7.

Copy of the order be uploaded on the High Court website and be also forwarded to learned counsels through email.
