O R D E R

% 29.01.2018 After some arguments, the learned counsel for the appellant states upon instructions that he would not press the present appeal if his application under Order XXXIX Rule 4 CPC, filed before the Trial Court, is taken up for disposal at the earliest. The learned counsel for the respondent, who appears on a diligent watch of the Cause List, states that he would have no objection to the said request.

In the circumstances, the Trial Court is requested to endeavour to dispose off the aforesaid application within a period of four weeks from the day the parties appear before it.

The parties shall appear before the Trial Court on 16.02.2018. The learned counsel for the respondent submits that their reply to the appellant's aforesaid application will be served and filed within

the next three days.

The learned counsel for the parties assure the Court that they would not seek any adjournment and would assist the Trial Court in the expeditious disposal of the application.

The appeal is disposed off in the above terms. A copy of this order be given dasti to the learned counsel for the parties.
