The present application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Section 439 of the Code of Criminal Procedure, 1973 seeking grant of interim bail to the Applicant in FIR No. 195/2024 registered at Police Station Samaypur Badli for offences punishable under Sections 302/34 of the Indian Penal Code, 1860. 3.

The Applicant/Petitioner seeks interim bail for a period of 45 days on the ground of medical treatment.

Learned counsel for the Applicant/Petitioner submits that the Applicant/Petitioner is suffering from lower backache associated with radiculopathy, with pain radiating to both lower limbs. He further submits that the Applicant/Petitioner is also suffering from posterior anal fissure associated with bleeding per rectum and pain during defecation for the last three months.

indicates that the Applicant/Petitioner is being provided regular medical treatment and necessary medical care.

Learned APP for the State opposes the application and submits that the Applicant is an undertrial in a case registered under Section 302 IPC and the trial is presently pending before the learned Trial Court at Rohini. 7.

The Nominal Roll dated 20.05.2026 reflects that the Applicant has undergone custody for a period of 2 years, 3 months and 3 days. 8.

This Court has considered the submissions made and perused the material placed on record.

The status report shows that the Petitioner/Applicant is receiving regular medical treatment through the Jail Authorities.

In view of the nature of the allegations against the Applicant and considering that he is receiving regular medical treatment, this Court is not inclined to grant interim bail on medical grounds. 10.

At this stage, learned counsel for the Applicant draws the attention of this Court to the order dated 25.10.2024 passed by the learned Trial Court, wherein it was observed that the Applicant was in need of surgery. 11.

It may be noted that the said order was passed in the year 2024. As on date, no medical record has been placed on record to indicate that the surgery is still required. Therefore, the said order does not advance the case of the Petitioner/Applicant.
