The present application has been filed under Section 438 Cr.P.C. seeking anticipatory bail in FIR No. 94/2020 registered under Sections 147/148/149/324/307 IPC at P.S. New Usmanpur. 2.
Learned counsel for the petitioner submits that the petitioner was a minor at the time of the incident. He further submits that in compliance of the order dated 01.07.2020, the petitioner has joined the investigation. 3.
A Status Report has been placed on record. As per the Status Report, the present petitioner is stated to be a minor at the time of commission of the offence. Mr. Saleem Ahmad, learned SPP submits that the present petitioner being juvenile shall be dealt with in accordance with law. 4.
In view of the above, the interim order dated 01.07.2020 is made BAIL APPLN. 1492/2020 Page 1 of 2
absolute and it is directed that in the event of his arrest, the petitioner be released on bail, on his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned IO/SHO and subject to the following further conditions: (i) The petitioner shall not leave the NCT of Delhi without prior intimation to the IO/SHO P.S. New Usmanpur. (ii) The petitioner shall appear before the concerned Court as and when the charge-sheet is filed in the case. (iii) The petitioner shall not try to get in touch with any of the prosecution witness or tamper with the evidence. 5.
