CORAM:

HON'BLE MR. JUSTICE BRIJESH SETHI

O R D E R

% 18.09.2019 C.M.No. 8069/2019 (exemption) Allowed, subject to all just exceptions.

W.P.(CRL) 1089/2019 The present petition has been instituted under section 482 Cr.P.C. for quashing of FIR No.03/2018 registered under Sections 323/308/506/34 IPC at police station Gokulpuri.

Learned ASC for the State submits that the petitioners and respondent no.2 are neighbours. A dispute over a trivial issue led to the registration of the aforementioned FIR against all three petitioners and respondent no.2 is the only complainant.

W.P.(CRL) 1089/2019 P-1/2

All the three petitioners and the complainant are present in Court along with their respective counsels and have been identified by the investigating officer.

It is submitted by the learned counsel for the parties that with the intervention of well wishers and elders, the parties have settled their dispute amicably in terms of Compromise Deed dated 16.01.2019, copy whereof is on record as Annexure B.

Respondent no.2/complainant, who is present in Court admits the factum of settlement arrived at with the petitioners and he further states that he has entered into a settlement with the petitioners on his own free will and without any undue force or coercion from any source whatsoever. He further states that in view of the settlement, he has no objection if the aforementioned FIR is quashed.

In view of the above facts, no fruitful purpose would be served in continuing criminal proceedings against the petitioners. Accordingly, the FIR No.03/2018 registered under Sections 323/308/506/34 IPC at police station Gokulpuri and consequential proceedings thereof, are hereby quashed.

The petition stands disposed of.
