O R D E R

% 06.08.2020 1.

The present bail application has been filed on behalf of the petitioner seeking interim bail for a period of 60 days in FIR No. 121/2016 under Sections 20/25 of NDPS Act, registered at Police Station Crime Branch, Delhi.

Learned counsel for the petitioner submits that the petitioner has been in custody since 14.07.2016. He submits that most of the prosecution witnesses have been examined. He has referred to the Medical Status Report dated 07.07.2020 received from the Jail Dispensary, Central Jail No. 1, Tihar, New Delhi.

As per the said Medical Status Report the petitioner is a known case of PLHA (Patient living with HIV/AIDS) and has been under constant review and treatment by jail duty doctors as well as by jail visiting specialist and ART Centre, Central Jail Hospital. It is also stated that the petitioner has also been examined by the Orthopaedic as well as Skin Specialist for various issues.

Learned counsel for the petitioner submits that the petitioner was earlier granted interim bail on four occasions and he has not misused the concession granted to him.

A Status Report has been placed on record. It has been stated in the Status Report that the petitioner was diagnosed with HIV in the year 2018. Learned APP for the State submits that 9 prosecution witnesses out of 13 witnesses have already been examined.

Keeping in view the facts and circumstances of the case, the petitioner is admitted to interim bail till 31.08.2020, on his furnishing a personal bond in the sum of 25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty MM and subject to the following conditions :- (i) The petitioner shall not get in touch with the prosecution witnesses directly or indirectly and shall not make any effort to tamper with the evidence.

(ii) The petitioner shall remain available on his mobile number i.e., 8449707699, which he undertakes to keep operational during the period of his interim bail.

(iii) The petitioner shall further remain in touch telephonically with Inspector Vivek Pathak, P.S. Crime Branch on mobile number: 9811699569 as well as SHO Kotwali Hathras, on every Monday and Friday during the period of his interim bail.

(iv) The petitioner shall surrender at the expiry of his interim bail before the concerned Jail Superintendent.

With the above directions, the bail application is disposed of. 8.
