The present application has been filed under Section 439 Cr.P.C. seeking interim bail in FIR No. 303/2014 under Sections 302/307/34/120B IPC registered at P.S. Subzi Mandi on the ground that the petitioner's mother requires to undergo surgery for pelvic stone, which is scheduled for 09.07.2020.

The status report has been filed. As per the status report, the medical documents in respect of the petitioner's mother have been verified. It has been stated that the petitioner's mother lives alone in the house and the petitioner's younger brother is admitted in a de-addiction centre. In this regard, statement of one of the neighbours namely, Smt. Premwati was also recorded who has confirmed the same. Mr. Jitender Sethi, learned counsel for the petitioner submits that the petitioner-Vikrant Sagar is in custody since 10.11.2014. He further submits that the petitioner has already been released on interim bail on three occasions vide orders dated 23.10.2017, 30.08.2018 and 18.04.2020 and has not misused the concession of interim bail at any of point of time, inasmuch as, surrendered in due time.

Keeping in mind the totality of the facts and circumstances of the case, it is directed that the petitioner be released on interim bail for a period of four weeks from the date of his release, subject to his furnishing a personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent/Duty M.M./concerned Court and also subject to the following conditions :- i) The petitioner shall not leave the NCT of Delhi during the period of his release;
ii) The petitioner shall be available on his mobile number 8595627963, which he undertakes to keep operational at all times, and shall report to IO SI Praveen (Mob. No. 9899993266)/SHO P.S. Subzi Mandi on every Monday and Friday during the period of his release; iii) The petitioner shall not try to get in touch with the complainant or any other prosecution witness directly or indirectly and shall not make any effort to tamper with the evidence during the period of his release; iv) After expiry of the interim bail period, the petitioner shall surrender before the concerned Jail Superintendent. 5.
