% 30.07.2020 (Video Conference Hearing) By the instant application, the applicant seeks interim bail founded on the recommendations of the High Powered Committee dated 18.05.2020. Applicant is stated to be in JC since 03.05.2014 and as per the nominal roll, he has undergone incarceration for 6 years 2 months and 12 days as on 24.07.2020 and his conduct is satisfactory. The recommendations of the High Powered Committee cover the case of the applicant for grant of interim bail. In the submission of Mr. Oberoi however, the applicant does not deserve any indulgence in view of the fact that he is involved in a heinous crime and that, the victim was a young girl aged about 23 years and that, the date of hearing for recording of

evidence is scheduled for 07.09.2020 only.

Sympathies do have their own place, the Court cannot ignore the attending facts and the circumstances on which the prayer is founded. The case of the applicant is squarely covered within the parameters of recommendations of High Powered Committee and the prevailing conditions on account of Covid-19 continue to take its own toll. Taking into account the totality of facts and circumstances, the applicant is admitted to interim bail for a period of 45 days from the date of his release on his executing a Personal Bond in the sum of Rs.50,000/- to the satisfaction of the concerned Jail Superintendant. Application stands disposed of accordingly.
