The Present Petition under Section 378(3) Cr.P.C. has been filed by the Petitioner seeking leave to Appeal against the Order dated 04.12.2018 passed by the learned Metropolitan Magistrate, whereby Respondent No.1 has been acquitted of the offence under Sections 341/506 IPC in Complaint No. 4988839/2016, registered at Police Station Dwarka North, New Delhi. 2.
Learned Counsel for the Petitioner has submitted that the learned Trial Court has failed to appreciate that the Petitioner could not mention the fact of being restrained by the Respondent in the Complaint dated 30.07.2013 and has not appreciated the evidence and has acquitted the accused. 3.
For the reasons stated in the Application, Leave to Appeal is allowed. 4.
The Petition stands disposed of.
