IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 3984/2019 MUKESH KUMAR VAID ..... Petitioner Through Mr Manishi Bisht, Advocate.
versus OFFICE OF THE DISTRICT ELECTION OFFICER AND ORS.
..... Respondents Through Mr Ramesh Singh, Standing Counsel with Mr Shadan Farasat, ASC, Mr Hafsa Khan, Mr Chirayu Jain, Advocates for R1 and R2.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 16.04.2019 1.
The petitioner has filed the present petition, inter alia, praying that directions be issued to the respondent nos. 1 and 2 to provide a certified copy of the affidavit of Sh Bhim Singh, son of Sh Tej Ram, which he had filed along with his nomination paper for contesting the election to the Legislative Assembly from Vishwas Nagar in the year 2013. 2.
The petitioner had filed an application dated 30.10.2017 for seeking the aforesaid information under the Right to Information Act, 2015 (RTI Act). The CPIO responded to the said application by a letter dated 19.12.2017 informing the petitioner that the information as sought for by him was available on the website. The petitioner claims that the documents as uploaded on the website are blurred and not legible and, therefore, he
seeks a certified copy of the said documents. 3.
It is seen from the above that the petitioner is, essentially, aggrieved by non-supply of information under the RTI Act. The petitioner has not availed of the alternate appellate remedies available to him. 4.
In view of the above, the present petition is disposed of by leaving it open for the petitioner to avail of the appellate remedies as provided under Section 19 of the RTI Act.
