Petition under Section 528 BNSS has been filed on behalf of the Petitioner for quashing of Order dated 13.02.2025 in Criminal Revision No.53/2025 of learned ASJ/Special Judge, NDPS. 2.

It is submitted in the Petition that the Complaint under Section 138 N.I.Act was filed which was delayed by 42 days which should have been considered by the learned M.M. He, however on 29.01.2025 took cognizance and inadvertently overlooked the condonation Application. Against this Order dated 29.01.2025, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Criminal Revision was preferred in which the Order dated 29.01.2025 of the learned M.M has been stayed.

Learned senior counsel submits that since the condonation Application should have been considered by the learned M.M which got inadvertently overlooked, the matter should be remanded back to the learned M.M for consideration of the condonation Application. 4.

Since the Criminal Revision already stands filed, the present Petition as requested, is permitted to be withdrawn with liberty to move an Application before the learned ASJ for preponement and for consideration of the submissions for remand of the case to the learned M.M.

The Petition is accordingly disposed of.
