Learned counsel for the petitioner fairly submits that Village Ghitorni has been urbanized and as such the DLR Act, 1954 would cease to apply to said village. He also fairly submits that following the judgment of Supreme Court in Mohinder Singh (Dead) Through LRs and Anr. vs. Narain Singh and Ors reported in 2023 SCC OnLine SC 261, the proceedings itself would be non-est in law. He seeks to withdraw the present petition with liberty to file the same before the competent Court of Civil jurisdiction by way of an appropriate proceedings.

In view of above, the petition along with pending applications is dismissed as withdrawn with liberty so sought is granted.
