% 09.02.2026 CRL.M.A. 4440/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks advancement of the date of hearing, which is otherwise posted on 19.03.2026; and disposal of the writ petition as infructuous, in view of the Look-Out-Circular ('LOC') issued against the petitioner having been closed. Furthermore, the petitioner seeks release of the passports of the petitioner's parents, that were deposited with the Registry of this court. The petitioner also seeks release of the FDR of Rs.20,00,000/-, which is also lying deposited with the Registry of this court.

Learned counsel are present on behalf of the respondent Nos. 1 to 3/ Union of India as well as for respondent No.4/Directorate of Enforcement ('ED'), the last of them being the contesting respondent. 4.

Learned counsel for the respondents do not oppose the prayer made in the application.

Learned counsel for the ED confirms that the LOC has been closed, as stated on behalf of the petitioner.

In view of the above, the present application is allowed. 7.

The registry is directed to return to Sh. Vijay Gupta and Smt. Kusum Gupta, the parents of the petitioner their passports deposited with the registry; and also to release to the petitioner the FDR deposited by him in the sum of Rs. 20,00,000/- alongwith interest accrued, if any. 8.

Let the needful be done within 02 weeks of the petitioner and the aforesaid concerned persons approaching the Registry for the purpose, subject to verifying their credentials. W.P.(CRL) 1124/2025 9.

In view of the order passed above, the present petition is disposed-of as infructuous.
