O R D E R

The petitioner has filed the present application, inter alia, seeking interim bail for a period of three months in FIR No. 137/2020 under Section 419/420/34 IPC registered with PS Special Cell. 2.

The said FIR was registered on a complaint wherein it is alleged that the accused had invited applications for employment from various persons by floating a website - www.ayushman-yojana.org. It is alleged that the name of the said website appears to be similar to the scheme floated by the Central Government and number of persons (alleged to be four thousand persons) were duped into applying for a job on the basis of the said website. All applicants were required to submit a certain amount along with their respective applications.

The petitioner claims that the website was made in respect of a registered trust. The petitioner submits that the Trust had invited

applications for employment as well as membership of the said organization. At this stage, it is not necessary to evaluate the evidence against the petitioner or his defence. Suffice it to state that the nature of allegations indicate that the same would be supported by documentary evidence or electronic footprint, which is otherwise available. 4.

In view of the above, this Court considers it apposite to allow the present application and direct that the petitioner be released on interim bail for a period of three months from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- and one surety of the equivalent amount to the satisfaction of the Jail Superintendent/Duty Magistrate. 5.

This is also subject to the following further conditions:- (a) that the petitioner shall not leave the National Capital Region of Delhi;

(b) that the petitioner shall provide a contact number to the IO and ensure that he is reachable at all times; (c) that the petitioner shall contact the Investigating Officer telephonically on Monday of each calendar week and disclose his whereabouts;

(d) that the petitioner shall not contact any of the witnesses directly or indirectly.
