The present petition has been filed alleging willful disobedience of the judgment dated 15th November, 2016 passed in RFA (OS) No. 113/2015. 2.

Vide the aforesaid judgment, the decree was modified and the Court had directed that the petitioner herein would vacate the barsati/first floor of property bearing No. D-3 Green Park Extension, New Delhi, on or before midnight of 31st December, 2016, provided that the respondent no. 1 would first deposit in this court, a sum of Rs. 1,20,000/- as an advance payment for four months commencing from January, 2017. It had further been directed that the petitioner shall be paid a sum of Rs. 30,000/- per month. 3.

Since, the aforesaid judgment was not been complied with, the present contempt petition came to be filed.

Today, learned counsel appearing for the respondents puts in appearance and submits that the aforesaid judgment is being duly complied with. He submits that an amount of Rs. 30,000/- per month is being paid to the petitioner herein, which fact is not disputed by the petitioner, who is appearing in person.

Learned counsel appearing for the respondents submits that the respondents are in talks for selling/collaboration of the property in question. He submits that appropriate application shall be moved in that regard thereto. He further submits that before taking any action, an application shall be moved for seeking permission from this Court in terms of the judgment dated 15th November, 2016.

Recording the aforesaid submission made by learned counsel for the respondents, no further orders are required to be passed in the present petition.

Needless to state, the respondents shall continue to make payment of Rs. 30,000/- per month to the petitioner regularly. 8.
