Mr. Ankur Mahindro, learned counsel for the plaintiff submits that during the pendency of the present petition, the parties were referred to mediation where they have arrived at a settlement, terms whereof have been reduced into writing in the form of Settlement Agreement dated 17.11.2025. 2.
He submits that the plaintiff seeks to withdraw the present suit unconditionally in terms of the said settlement. 3.
Mr. Sudhakar Mohan Mudgil, learned counsel for the defendant, who has joined through VC affirms the factum of settlement and submits that he has no objection to the withdrawal of the suit. 4.
In view of the above, the suit is dismissed as withdrawn. 5.
At this stage, Mr. Mahindro, learned counsel for the plaintiff submits that the entire Court Fee affixed on the plaint may be refunded to the plaintiff.

Having regard to the fact that the parties have arrived at a settlement before the mediation, which is one of the modes of settlement referred to in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Section 89 CPC, the plaintiff is entitled to the refund of entire Court Fee, in terms of Section 16 of the Court Fees Act, 1870. 7.
Accordingly, the Registry is directed to issue a certificate for the refund of full Court Fee in accordance with the rules. 8.
Accordingly, the suit stands disposed of.
