CRL.M.C. 2057/2019 & CRL.M.A.8169/2019 1.

Learned counsel for the petitioners as well as learned counsel for respondent No.2 submitted that the parties have settled their disputes before the Delhi Mediation Centre, Tis Hazari Courts, Delhi, in terms whereof the petitioner has already handed over four cheques to the respondent No.2 and assured that all the four cheques shall be encashed by the bank. Learned counsel for the petitioners as well as learned counsel for respondent No.2 submitted that the parties shall remain bound by the terms and conditions of the settlement arrived at

between the parties and their statements may be accepted and taken as undertakings on behalf of the petitioner No.1 and respondent No.2. The statements made by the learned counsel for the petitioners and respondent No.2 are accepted and the same are taken on record as undertakings on behalf of the petitioner No.1 and the respondent No.2.

Learned counsel for the petitioners submitted that, in view of the settlement arrived at between the parties, he may be allowed to withdraw the petition, with liberty to file the same in case of breach of any terms and conditions. Learned counsel for the petitioners also submitted that as per the terms and conditions of the settlement between the parties, the petitioners may file a petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of the FIR, after the last payment is made. Learned counsel for the respondent No.2, on instructions, submitted that he is having no objection in case such a petition is moved after the last payment, in terms of the settlement, is made.

Accordingly, the petition is dismissed as withdrawn with the liberty as prayed for. Pending application is also dismissed as withdrawn.
