% 03.07.2020 The hearing has been conducted through Video Conferencing. 1.

By this petition the petitioner seeks interim bail in case FIR No. 54/2014 under Section 21/29 NDPS Act registered at PS Special Cell on the ground that the wife of the petitioner has to undergo surgery. 2.

A status report has been filed indicating that the petitioner and the coaccused were arrested after certain mobile phones were kept on interception on the suspicion that a group of person was indulging in supplying narcotic drugs.

During the course of interception it was revealed that the petitioner was a resident of Trilokpuri, used to deal in sale of heroine in retail and used to procure the said contraband from one Javed @ Rakesh of Rampur, U.P. through his own carrier, namely, Dharma. During the course of interception it was revealed that the petitioner had also received a consignment and hence technical surveillance was done. On 24th November, BAIL APPLN. 1515/2020

2014 when Dharma came to supply the heroine to the petitioner near Union Bank ATM, 31 Block, Trilokpuri, a raid was conducted. Heroine was recovered at the spot and thereafter also at the instance of the petitioner. 4.

Presently, the petitioner seeks interim bail on the ground that his wife is to be operated on 8th July, 2020. The factum of proposed surgery of the petitioner's wife has been verified at Metro Plus Hospital, Thana Road, Chhawla Stand, Najafgarh.

As per the status report the petitioner was earlier also granted interim bail for his treatment when he surrendered in time. Thus, even though coaccused have absconded subsequent to their arrest, the fact that the petitioner surrendered after earlier interim bail was granted goes in his favour.

Consequently, this Court deems it fit to grant interim bail to the petitioner. It is therefore directed that the petitioner be released on interim bail for a period of four weeks on his furnishing a personal bond in the sum of ₹2 lakhs with one surety bond of the like amount to the satisfaction of the learned Trial Court/ ACMM/ Duty Magistrate, further subject to the condition that in case the surgery of the petitioner's wife is not performed on 8th July, 2020 the petitioner will surrender to custody back on 9th July, 2020. 7.

Petition is disposed of.
