The Petitioners claim to be the owner of land RZ-345/17, Khasra Nos. 870/345 & 869/345, Village Nasirpur, West Sagarpur, New Delhi - 110046.3 He seeks a direction upon the Respondents to carry out demarcation of the 1 "GNCTD"

However, in view of the fact that the village in question has been urbanised by notification under Section 507 dated 24th October, 1994 and vide notification under Section 22(1) dated 08th August, 2002, there exists a jurisdictional ambiguity regarding whether the demarcation exercise is to be undertaken by DDA or GNCTD.
4. As far as this aspect is concerned, in Luv Nagpal & Anr. v. Govt. of NCT of Delhi,4 it was directed GNCTD and DDA to conduct the demarcation exercise jointly in the presence of the Petitioners or their representatives, so that the process is not held up pending resolution of the jurisdictional issue.
5. The same approach has been followed in subsequent decisions, including Rajender Singh & Anr. v. SDM Revenue Assistant Mehrauli.5
6. Counsel for the Respondents submit that the present writ petition may also be disposed of on the same terms.
7. The writ petition is, therefore, disposed of with the direction that the demarcation exercise in respect of the subject land will be carried out through a third-party agency, in co-ordination between GNCTD and DDA, within a period of three months from today. The Petitioners or their representatives will be associated with the demarcation exercise, and the expenses thereof shall be borne by the Petitioners.
8. It is made clear that the aforesaid directions are subject to any orders passed by the Full Bench in Original Reference No. 1/2024. It is further clarified that this order is passed without prejudice to the rights and 3 "subject land"
