Applicant seeks regular bail in case arising out of FIR No.0076/2025 dated 20.01.2025, registered at P.S. Samaipur Badli, Delhi, for commission of offences under Sections 109(1)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 307/34 IPC).

The incident in question is of 19.01.2025.

As per allegations appearing in the abovesaid FIR, informant-Priyansh Yadav had gone to attend birthday party of one Sandeep and when he was coming out of his house, around 8-10 persons came from behind. The informant and his friend-Sandeep were attacked. Priyansh Yadav received stab injuries on his chest and left thigh. He named some of those persons, including Punnu, Himanshu, Santosh @ J, Sonu and accused Gandhi BAIL APPLN. 1679/2026 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Applicant was arrested on 21.01.2025 and is in continuous custody since then.

As far as accused-Roshan Kumar Patel is concerned, he has, reportedly, been granted anticipatory bail. He was also one of the assailants. Two other co-accused persons i.e. Punnu @ Puneet and Santosh @ Jai have also been enlarged on bail by the learned Trial Court. 6.
The Charge-sheet and supplementary charge-sheet have been submitted but fact remains that trial has yet not begun, as charges have not been framed so far.

Learned counsel for the applicant submits that the applicant is 19 years of age with no previous involvement. She also submits that the exact genesis of the quarrel and incident is not very clear as the injured himself was found to be under the influence of alcohol when he was admitted in the hospital. 8.
Nominal Roll has been requisitioned which also indicates that the applicant is 20 years of age, with no previous involvement of any nature whatsoever.

Keeping in mind the overall facts and circumstances of the case, the applicant is, hereby, admitted to bail, on their furnishing personal bond in a sum of Rs. 25,000/- with one 'local' surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate with the following conditions:- (a) The applicant shall appear before the Court regularly, (b) The applicant/accused shall not come in contact of the witnesses, directly or indirectly.
