O R D E R

% 22.01.2018 By this petition the petitioner inter-alia prays for a writ of mandamus directing the respondents to provide the petitioner protection to safeguard his life and liberty.

Case of the petitioner is that petitioner is public oriented person. Petitioner has filed number of PILs against builders and thus at any point of time he and his family members are being disturbed and threatened. It is the case of the petitioner that his father was brutally attacked on 28th September, 2015.

In the status report the fact that the petitioner has filed various complaints and Court cases/ RTI applications against the encroachments/ unauthorized construction against various builders is not disputed. It is stated that on the intervening night of 14-15th August, 2017 at around 12.25 W.P.(CRL) 508/2017

AM three persons namely Deboo, Mukesh and Rajesh barged into the house of the petitioner after breaking open the latch of the main door and they threatened the petitioner. The petitioner dialled 100 number from his mobile phone and requested the Police official to come in his residence when Deboo, Mukesh and Rajesh entered into the room of the petitioner, however the Police did not reach.

Though investigation in the FIR registered on the complaint of the petitioner are going on, needless to note the State has already given an undertaking that they have provided the mobile number of the SHO, Division Officer and beat staff to the petitioner. The Division Officer and beat staff are regularly visiting house of the petitioner and they have been directed to remain in touch. Considering the facts and circumstances of the case this Court thus deems it fit to direct the respondents to ensure the protection of the petitioner though beat staff and in case of any specific complaint action thereon be taken in accordance with law.
