O R D E R

The present application has been filed seeking interim bail in FIR No.37/2016 registered under Sections 489(B)/489(C)/120-B IPC and Section 15(iii) of Unlawful Activities Act at Police Station Special Cell. 2.

Learned counsel for the petitioner submits that the petitioner's wife is suffering from serious ailments and has been under treatment at Rajpura, Punjab and is presently at Metro Plus Hospital, Najafgarh, Delhi. 3.

Learned counsel for the petitioner also submits that in case the petitioner is released on interim bail, he shall stay at F-295, J.J. Colony, Madipur, New Delhi and shall remain available at the Mob. No. 9814766968.

As per the Verification Report dated 05.08.2020, the aforesaid address has been verified. In the subsequent verification report dated 26.08.2020, the

treatment record of petitioner's wife has been found to be correct and it has been stated as follows:- "1.

She is being treated for Dysfunctional uterus Bleeding and Pelvic inflammatory disease. She is having high grade infection and blood loss anaemia.

She is advised conservative treatment for this but she needs further evaluation and investigation.

Presently, she needs hospitalization due to her poor general condition and high level of infection. She has been advised for 2 units blood transfusion. She might take 4-6 weeks to recover.

She needs further investigation and review by gynaecologist and D.V.B if not responding to medicine may require surgery (Hysterectomy) but presently she is on medical management."

Learned counsel for the petitioner submits that the petitioner's wife will undergo treatment either at present hospital or at any other referred hospital in Delhi. He further submits that the petitioner's jail conduct has been opined to be satisfactory.

In view of the facts and circumstances of the case and the fact that the petitioner's wife is suffering from serious ailments, the petitioner is admitted to interim bail for a period of four weeks on his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty MM/concerned Court and subject to the following conditions:-

(i) The petitioner shall not try to get in touch with the complainant or any other prosecution witness directly or indirectly and shall not make any effort to tamper with the evidence.

(ii) The petitioner shall not leave the jurisdiction of NCT of Delhi during the period of interim release without the prior permission of the concerned Court.

(iii) The petitioner shall remain available on his telephone number (Mob. No. 9814766968) which he undertakes to keep operational at all times.

(iv) The petitioner shall report to the I.O. Insp. Sumit (Mob. No. 9999197859) on every Monday and Friday telephonically during the period of his interim release. (v) The petitioner shall surrender before the concerned Jail Superintendent after the expiry of the period of his release.

With the above directions, the present application stands disposed of alongwith the pending application.
