The present petition has been filed under Section 439 CrPC read with Section 482 CrPC seeking bail in connection with FIR No.714/2022 under Section 307 IPC registered at Police Station Wazirabad. 2.
Notice was issued in the present petition on 18.05.2023 with a direction to the State to file its Status Report. A copy of the Status report has been handed over in the Court, the same is taken on record. 3.
The case of the prosecution is that on 28.08.2022 at around 03:30 p.m, one lady Kiran told the complainant/victim by shouting that on the ground floor, the tenant/accused Vikrant, his wife and one other person were fighting with each other and not opening the door. The learned counsel for the petitioner submits that during the pendency of the proceedings the complainant, as well as, the father of the petitioner/accused have arrived at a settlement. The factum of settlement is not disputed by the learned APP, on instructions from the IO who is present in Court.

It is a term of the settlement that the complainant shall cooperate with the petitioner for the quashing of the FIR in question. 6.
Considering the fact that the parties have arrived at a settlement, the petitioner is enlarged on bail subject to his furnishing a Personal Bond in the sum of Rs. 25,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.
b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
c) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. 7.
The petition stands disposed of.
