The petitioners have filed the present petition, inter alia, praying that FIR bearing No. 509/2015, under Sections 406/498-A/34 of the Indian Penal Code, 1860 registered at PS Kamla Nagar be quashed. 2.
The petitioners and respondent no. 2 (Ms. Nazia Parveen) are present in court. The petitioners are identified by the counsel and respondent no.2 is identified by the Investigating Officer. It is stated that the petitioners and respondent no.2 have since settled their disputes before Delhi Mediation Centre, Tis Hazari Court, Delhi. The said parties have entered into a settlement dated 06.10.2016, whereby the petitioner has agreed to pay a sum of ₹3,50,000/- (Three Lacs Fifty Thousand Only) to respondent no.2, as permanent alimony, stridhan, Mehar, Iddat amount and maintenance for her as well as for maintenance of her son, aged four years. 3.
In terms of the settlement, petitioner no.1 and respondent no.2 had
also agreed to divorce. The parties state that the said settlement has been implemented. Respondent no.2 states that she has received the entire sum of ₹3,50,000/- in terms of the settlement arrived at between the petitioners and respondents. She further states that she does not wish to pursue any proceedings against the petitioners and the FIR in question may be quashed. 4.
In view of the above, the present petition is allowed and the FIR bearing No. 509/2015 is quashed. All proceedings emanating therefrom are also quashed.
