Criminal Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.' has been filed on behalf of the Petitioners, for quashing of FIR No. 328/2024 dated 26.12.2024 under Section 118(1)/126(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'BNS') registered at Police Station Shaheen Bagh and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 29.01.2025.

On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State.

Brief facts of the case are that the Respondent No. 2, namely, Mr. Ajane Shajid Ahmad sells the clothes by putting a cart on the road. Royal Hotel. Just then, two boys came on the micy and said to him, sisterfucker, watch and drive. The Respondent no. 2 stopped those boys from abusing and they got into an altercation. After 10 minutes, they came again and caught hold of the Complainant and started beating him. One of the boys attacked him with a knife with several times. Thereafter, both the boys ran away. The Complainant's sister, Uzma came and called the Police. PCR vehicle came and took him to the Apollo Hospital. From there, he was taken to AIIMS Trauma Centre where Doctor asked him to get admitted but due to fear, the Complainant came to his home. 5.

On the Complaint of the Respondent No.2/Complainant, FIR No.328/2024 dated 26.12.2024 under Section 118(1)/126(2)/3(5) of BNS, got registered at Police Station Shaheen Bagh. 6.

It is submitted that the FIR was a consequence of the disputes between the Complainant and the Petitioners. It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Compromise Deed dated 29.01.2025. In the Settlement, it was inter alia settled between the parties that the Petitioners shall pay a total sum of Rs.40,000/- to the Respondent No. 2 as medical treatment. It is also settled between the parties that they shall live peacefully. It is further settled between them that any Complaint made against each other, shall stand withdrawn, cancelled and revoked finally.

Today, the Respondent No. 2/Complainant, who is present in the Court, states that he has received all amounts due to him and has no objection if the said FIR is quashed.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 328/2024 dated 26.12.2024 under Section 118(1)/126(2)/3(5) of BNS, registered at Police Station Shaheen Bagh and all the consequential proceedings emanating therefrom are quashed. 10.

The Petition is disposed of accordingly.
