% 27.07.2020 1.
This hearing has been held through video conferencing. 2.
The Petitioner seeks interim bail for 45 days in view of the minutes of the High Powered Committee dated 18th May, 2020. He has been accused of committing offences under Sections 302/34 of IPC and Sections 25/27 of Arms Act. Notice was issued on 3rd July, 2020. The status report has also been filed in this matter.
3.
Ld. counsel for the Petitioner submits that there is no other case in which the Petitioner is involved, contrary to what was stated by the Investigating Officer (IO) before the ld. Sessions Judge. He further submits that in the order dated 8th June, 2020 of the ld. ASJ, it is wrongly recorded that the Petitioner's conduct in jail was unsatisfactory, in view of another case.
4.
The nominal roll has now been received, which clearly shows that the Petitioner's conduct in jail has been satisfactory. He has been in custody for
more than two years and seven months. The status report also shows that there is no involvement in any other case and the father of the Petitioner is suffering from severe anxiety and depression. 5.
On the last date of hearing, the Court had adjourned the matter in order to enable ld. APP to check if the Petitioner is involved in any other case. Mr. Raghuvinder Verma, ld. APP, on instructions from the IO submits that the other offences have already been compounded and involvement in FIR No. 371/2017 has been wrongly mentioned in the order dated 8th June, 2020.
6.
In the overall facts and circumstances, considering that all conditions as per Minutes of the High Powered Committee have been fulfilled, interim bail for 45 days is granted to the Petitioner from the date of his release, subject to the following conditions:
(i) The Petitioner shall furnish a personal bond of Rs.20,000/- with one surety of like amount to the satisfaction of Jail Superintendent.
(ii) The Petitioner shall not leave Delhi.
(iii) The Petitioner shall give his live mobile number to the concerned IO and shall be in touch with the IO on a regular basis.
(iv) The Petitioner shall not contact any witness or take any steps which could cause obstruction in the trial in any manner whatsoever.
7.
The Petitioner shall surrender immediately upon the expiry of 45 days, from the date of his release.
8.
Copy of this order be sent to the Jail Superintendent, Central Jail No.
12, Mandoli Jail for compliance.
9.
The petition is disposed of in these terms, along with all pending applications.
