This writ petition is filed by the petitioner seeking a direction to respondent No.2 to admit the petitioner to First Class/Standard as per RTE Act and other provisions applicable to students belonging to EWS category. 2.
It is the case of the petitioner that the family of the petitioner belongs to the EWS category and as such he is eligible for admission under EWS quota. The father of the petitioner applied on the portal. The petitioner was allotted respondent No.2/Modern School.
Thereafter, the petitioner approached respondent No.2/Modern School but was not offered admission despite being recommended by respondent No.1. 3.
Respondent No.1 has placed on record a communication being dated 01.07.2020 written by respondent No.2 to respondent No.1 stating that they have a vacancy in Class-1 for the petitioner child who can be accommodated.

Despite service, none has appeared for respondent No.2. Respondent
is proceeded ex parte.

Accordingly, respondent No.2 is directed to give admission to the petitioner as stated by them in their communication dated 01.07.2020 to respondent No.1.

In view of the above, petition stands disposed of. All pending applications, if any, also stand disposed of. JAYANT NATH, J.
