Mr. Yogesh K. Jagia, who appears for the defendant, affirms this position and says that the defendant would have no objection to the prayer made by Mr. Kapoor for leave to withdraw the instant proceedings. 3.
Accordingly, as prayed, the instant suit and the captioned application shall stand dismissed as withdrawn.
