% 23.03.2018 Learned counsel for the petitioner submits that petitioner has nothing to do with this case. It is not the case of the prosecution that petitioner along with main accused Pradeep Nain had robbed the complainant. Only allegation against the petitioner is that he was in constant touch with co-accused Pradeep Nain on mobile phone during the robbery. It is further submitted that, as per the prosecution, petitioner was in touch with co-accused Pradeep Nain through mobile number 9250050016. Learned counsel for the petitioner submits that this mobile number does not belong to

the petitioner. Charge-sheet has already been filed against Pradeep Nain and trial is pending.

Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of `10,000/-(Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.
